These Terms of Service (“Terms”) are a legal agreement between you and Scout frl (“Scout”, “we”, “us”, or “our”) and govern your use of the Scout mobile application and any related services (the “Service”). By creating an account or using Scout, you agree to these Terms. If you do not agree, please do not use Scout.

01 Who we are

Scout is a global video-challenge platform. It lets people take part in Challenges created by others, create their own Challenges, upload Drops to showcase what they can do, respond to Challenges with their own videos, and earn Kudos from the community as they climb the leaderboard. These Terms apply to the Scout mobile app and any related services we operate.

02 Eligibility

You must be at least 13 years old to use Scout. If you are under the age of majority where you live, you confirm you have your parent or guardian’s permission to use the Service. We do not knowingly allow anyone under 13 to hold an account, and we will close any account we learn belongs to someone under 13.

03 Your account

You need an account to post, respond to Challenges, or give Kudos. You agree to:

  • Provide accurate information when you sign up
  • Keep your password secure and not share your account with anyone else
  • Tell us immediately if you think your account has been compromised

You are responsible for all activity that happens on your account.

04 Content you post on Scout

When you post a Drop, Challenge, Response, or video comment, you keep ownership of it. You are not signing your content away.

What you grant us is a licence — worldwide, non-exclusive, royalty-free, and sub-licensable to our service providers solely to operate Scout — to host, store, reproduce, display, and distribute your content within the Service, so that we can show it to other users, feature it on the leaderboard, and let people respond to it. This licence ends when you delete the content or your account, except where it has already been shared with, downloaded, or responded to by another user in ways we can no longer withdraw.

You confirm that:

  • You own the content you post, or have the rights and permissions needed to post it
  • Your content does not infringe anyone else’s rights (including intellectual property, privacy, or publicity rights)
  • You are the person actually appearing in and performing in videos you post as your own

05 Zero tolerance for objectionable content

Scout has zero tolerance for objectionable content or abusive conduct, including but not limited to:

  • Nudity, sexual content, or content that sexualises minors
  • Graphic violence, gore, or content that threatens or incites violence
  • Hate speech, harassment, bullying, or discrimination
  • Content promoting self-harm, dangerous acts, or illegal activity
  • Impersonation, spam, or deliberately misleading content

By using Scout, you agree not to post objectionable content and not to engage in abusive conduct toward other users. This is a condition of using the Service, not a guideline — accounts that break it face the enforcement in Section 10.

Because Scout is a video platform without automated pre-publish screening, we rely on this agreement, together with reports from the community, to keep the platform safe. If you see objectionable content or abusive behaviour, please report it using the in-app reporting feature. We commit to reviewing valid reports and acting on content that breaches these Terms — including removal — within 24 hours of receiving the report.

06 Reporting and blocking

Scout gives you two tools to control your experience:

  • Report — flag a video, comment, or account that breaches these Terms. We review reports and act under the commitment in Section 5.
  • Block — stop a specific user from contacting you, viewing your profile, or interacting with your content.

Misusing the reporting feature (for example, mass-reporting content you know is not in breach) is itself a breach of these Terms.

07 Kudos

Kudos are the way the Scout community recognises Responses and Challenges. To be clear:

  • Kudos are not money. They have no cash value.
  • Kudos cannot be bought, sold, transferred, or cashed out. There is no way to purchase Kudos in the app, and Scout is not a payment system.
  • Kudos exist only within the app, are tied to your account, and are used solely to rank content and contributors on Scout.

We may adjust how Kudos are calculated, weighted, or displayed (including the time-weighted Kudos Returns mechanic) at any time, to keep rankings fair and meaningful.

08 Challenges, Drops, and Responses

Challenges, Drops, and Responses on Scout are a way to compete, showcase skill, and get discovered — they are not gambling, a lottery, a prize draw, or a competition that requires payment or anything of monetary value to enter. No purchase, payment, or Kudos spend is ever required to create a Challenge, post a Drop, respond to a Challenge, or be featured or ranked on Scout.

Where Scout or a third party (such as an event partner or sponsor) offers a live event, prize, or opportunity connected to Challenge performance, any additional rules for that specific opportunity will be set out separately at the time, and entry will never require payment or the purchase of Kudos.

09 Acceptable use

In addition to Section 5, you agree not to:

  • Use Scout for any unlawful purpose
  • Attempt to access another user’s account without permission
  • Interfere with or disrupt the Service, including through automated bots, scraping, or attempts to manipulate Kudos or rankings
  • Reverse-engineer, decompile, or attempt to extract the source code of the app, except where the law gives you the right to do so
  • Use Scout to infringe anyone’s intellectual property or other rights

10 Termination and enforcement

We may remove content, suspend, or terminate your account, without prior notice, if we reasonably believe you have breached these Terms — including the zero-tolerance clause in Section 5. Depending on the severity of the breach, we may:

  • Remove the individual piece of content
  • Temporarily suspend the account
  • Permanently terminate the account

If your account is terminated, your right to use the Service ends immediately. Content you posted may remain visible to other users where it has already been shared, downloaded, or responded to, in the same way described in Section 4. You may also delete your account at any time from the app’s settings; our Privacy Policy explains what happens to your data and content when you do.

11 Disclaimers

Scout is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties, express or implied, about the Service, including as to its accuracy, reliability, or availability, or that it will be uninterrupted or error-free. We do not endorse, and are not responsible for, content posted by users.

12 Limitation of liability

To the fullest extent permitted by law, Scout frl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms limits our liability for death, personal injury caused by our negligence, or fraud, or any other liability that cannot be limited or excluded under English law.

13 Indemnity

You agree to indemnify and hold Scout frl harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.

14 Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of Scout will be subject to the exclusive jurisdiction of the courts of England and Wales, consistent with our registered address.

15 Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top. Continued use of Scout after a change constitutes acceptance of the updated Terms.

17 Additional terms for App Store users

If you downloaded Scout from Apple’s App Store, you also acknowledge the following, which apply between you and Scout frl and not Apple:

  • This agreement is between you and Scout frl only, not Apple. Scout frl, not Apple, is solely responsible for the Service and its content.
  • Your licence to use Scout is limited to a non-transferable licence to use the app on an Apple-branded product that you own or control, as permitted by the App Store’s Usage Rules.
  • Apple has no obligation to provide maintenance or support for Scout.
  • In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for Scout, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Scout frl’s sole responsibility.
  • Scout frl, not Apple, is responsible for addressing any claims by you or a third party relating to Scout or your possession or use of it, including product liability claims, claims that Scout fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • In the event of a third-party claim that Scout infringes that party’s intellectual property rights, Scout frl, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • When using Scout, you must comply with any applicable third-party agreements (for example, your mobile network’s data terms).
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18 Additional terms for Google Play users

If you downloaded Scout from Google Play, your use of Scout is also subject to Google Play’s applicable Terms of Service. Nothing in these Terms limits any rights you have under Google Play’s terms.
